(1) The proposer shall prepare an environmental study report as prescribed for the proposed proposal.
(2) The environmental study report prepared according to sub-section (1) shall be submitted to the following body after completing the prescribed process for approval: (a) Development projects with national priority, projects to be implemented after investment approval from the Investment Board, projects of national pride, development and construction related works or projects related to matters falling under the jurisdiction of the Union in accordance with prevailing laws, projects that require construction work in more than one province, or any designated by the Government of Nepal. Brief environmental study report or preliminary environmental test of the project proposal before the designated body and before the ministry if the environmental impact assessment report,
(b) In the case of proposals related to development works or projects related to matters falling within the jurisdiction of the provincial government, before the body designated by the relevant provincial law,
(c) In the case of proposals related to development works or projects related to matters falling within the jurisdiction of the local level, a brief environmental study report or a preliminary environmental test report to the body designated by the relevant local law and in the case of an environmental impact assessment report to the body of the provincial government designated by the provincial law.
(3) Notwithstanding anything contained in sub-section (1) and (2), environmental study reports submitted for approval at the time this Act commences shall not be hindered from being approved in accordance with the legal provisions in force at the time such report is submitted.
(4) Notwithstanding anything written elsewhere in this section, an environmental study report shall not be required when reconstructing a property considered to be an ancient monument in accordance with the Law on Ancient Monuments.
(5) The proponent shall hold a public hearing on the proposal as prescribed while preparing the environmental study report.
(6) Other provisions related to submission of environmental study report shall be as prescribed.
